That's true, but most people on dui charges have blown into a breathalyser.
Two points. I am not interested in "most people". I am interested in the idea that people pulled for DWI not spend time in jail with no demonstration of guilt. Further, a large portion of people arrested for DWI refuse to blow. Some as dodge and many as a right against search of their person. They lose their license for refusing. The license is a privilege. Their freedom is a right.
There is NO issue for me with releasing them to a responsible adult but a massive problem with jail. Heck, I think the automatic license suspension is wrong. I also believe it is wrong to allow a machine to determine guilt when the inner workings of the machine are not discoverable and the machine may not be tested by the accused.
